Os detritos espaciais são problemas graves que afetam a sustentabilidade do meio ambiente
espacial. O presente trabalho foi fruto de pesquisas bibliográficas, documentais e entrevistas,
que se propôs responder se a insuficiência de uma norma específica nacional para lançamentos de objetos espaciais do território brasileiro, impacta diretamente no acréscimo da geração de lixo espacial. O objetivo geral foi analisar as normas mitigadoras de detritos espaciais. Inicialmente, a pesquisa cumpriu identificar o atual tratamento normativo internacional acerca do tema e aferir os entraves contidos nessa legislação vigente. Em seguida, buscou verificar a existência de cooperação internacional sobre a sustentabilidade do cosmo e apontar os impactos ambientais, sociais, econômicos e políticos causados pelo lixo espacial e suas consequências, para, ao final, propor a criação de uma norma específica nacional responsabilizando os Estados pelos lançamentos de objetos espaciais a partir do solo brasileiro. Na análise de dados, foi realizada uma triangulação das informações obtidas entre as fontes de pesquisas usadas nesse estudo: bibliográfica, documental e entrevista. O método usado na investigação foi o hipotéticodedutivo. Concluiu-se que a carência de norma nacional brasileira pode contribuir no aumento dos riscos socioambientais, pois o País é responsável internacionalmente pelas consequências das atividades espaciais exercidas em seu território e para além dele, portanto devem haver esforços em prol da proteção e preservação do ambiente espacial. Space debris is a serious problem that affects the sustainability of the space environment. The
present work was the result of bibliographic, documents and interviews research, which
proposed to answer if the insufficiency of a specific national law for launching space objects
from Brazilian territory impacts the increase in the generation of space junk directly. The
general objective was to analyze the mitigating norms of space debris. Initially, the research
had to identify the current international normative treatment of the subject and to assess the
obstacles contained in this current legislation. Then, it sought to verify the existence of
international cooperation on the sustainability of the cosmos and to point out the
environmental, social, economic and political impacts caused by space debris and its
consequences, so, in the end, it proposes the creation of a specific national norm blaming the States for the launch of space objects on Brazilian soil. In the data analysis, a triangulation of the information obtained between the research sources used in this study was carried out: bibliographical, documental and interview. The method used in the investigation was hypothetical-deductive. It was concluded that the lack of a Brazilian national standard can contribute to an increase in socio-environmental risks, since the country is internationally responsible for the consequences of space activities carried out in its territory and beyond, therefore efforts must be made in favor of protection and reservation of the space environment.
