Esta pesquisa possui o objetivo de analisar se no ordenamento jurídico brasileiro existe norma jurídica de âmbito nacional que permita às forças de segurança federais, estaduais, distritais, bem como as guardas municipais, de atuarem de forma integrada e em conjunto com o Departamento de Controle do Espaço Aéreo (DECEA) e a Agência Nacional de Aviação Civil (ANAC) para fiscalização e abordagem das operações civis de voo com veículos remotamente pilotados. Um dos obstáculos para prevenção e repressão dos voos irregulares destas aeronaves é a falta de integração das forças de segurança com este objetivo, colocando em risco não somente pessoas e bens em solo, como também a segurança do controle do espaço aéreo nacional. A construção desse trabalho albergou a análise das normas emitidas pela administração pública direta, através dos mencionados órgãos de atuação, relacionadas à operação dos Sistemas de Aeronaves Remotamente Pilotadas (RPAS), de órgãos similares internacionais, como dos Estados Unidos, da China e da Europa, e da Organização Internacional da Aviação Civil (ICAO). Ainda incluiu análise normativa do sistema jurídico brasileiro para identificar a espécie normativa correta para inserir, em nosso País, lei de âmbito nacional relacionada à fiscalização das operações de voo com esses sistemas. Abstract: This research has the objective of detect whether there is a national legal normative in the Brazilian legal system that allows federal, state and district security forces, as well as municipal guards, to act in an integrated manner and in conjunction with the Department of Control of the Airspace (DECEA) and the National Civil Aviation Agency (ANAC) to oversee and approach civil flight operations with remotely piloted vehicles. One of the obstacles to preventing and repressing irregular flights by these aircraft is the lack of integration of security forces with this objective, putting at risk not only people and property on the ground, but also the security of the national airspace control. The construction of this work included the analysis of the norms issued by the direct public administration, through the mentioned action bodies, related to the operation of Remotely Piloted Aircraft Systems (RPAS), of similar international bodies, such as the United States, China and Europe, and the International Civil Aviation Organization (ICAO). It also included a normative analysis of the Brazilian legal system to identify the correct normative species to introduce, in our country, a national law related to the inspection of flight operations with these systems.
